This document outlines important terms and conditions governing your interactions with Patterson-Insurance, including electronic records and signatures. By engaging with our services, you agree to these terms. We may update these terms from time to time to reflect changes in our practices, new legal requirements, or operational reasons. Updates will be posted on our website at patterson-insurance.com, and the effective date will be revised accordingly. Your continued use of our services after any changes constitutes your acceptance of the updated terms.
These terms apply to residents of the United States, including those in Texas (under the Texas Data Privacy and Security Act and applicable insurance regulations) and Arkansas (under the Arkansas Personal Information Protection Act and the Arkansas Children and Teens’ Online Privacy Protection Act, effective July 1, 2026). We also comply with other state laws effective as of January 1, 2026, such as the Indiana Consumer Data Protection Act, Kentucky Consumer Data Protection Act, and Rhode Island Data Transparency and Privacy Protection Act, to the extent they apply to our operations based on thresholds for data processing volume, revenue, or other criteria. As an insurance provider, we adhere to federal laws including the Gramm-Leach-Bliley Act (GLBA) for financial privacy and the Electronic Signatures in Global and National Commerce Act (ESIGN Act) for electronic records and signatures, with no major federal updates effective in 2026 impacting these areas. In Arkansas, we comply with recent insurance reforms, including Act 651 (amending disclosures to policyholders) and Act 141 (permitting electronic medical records for providers), as applicable.
Electronic Record and Signature Disclosure (ESRD)
Patterson-Insurance strives to effectively and conveniently serve its customers (“you”).
From time to time, we may be required by law, or choose to, provide certain written notices or disclosures. By accepting these ESRD terms, you agree that you have read and understand them, and that you want to conduct business with Patterson-Insurance using electronic communications, to receive notices and disclosures electronically, and to use electronic signatures to make legally binding contracts. You are voluntarily electing to conduct matters electronically; if you prefer not to do so, you can receive paper copies as described below. I
This ESRD complies with the federal ESIGN Act and state equivalents, such as the Uniform Electronic Transactions Act (UETA) adopted in Texas and Arkansas. No significant updates to these laws took effect on January 1, 2026, but we monitor for any changes, including enhanced disclosures under Arkansas insurance laws.
Access to Electronic Documents
Patterson-Insurance understands that even if you want to receive documents electronically, you need to be able to read, access, print, and send them to effectively process and retain the documents. Our system allows you to view, download, print, and share (to another email address) any document sent electronically. See the system requirements below. By accepting, you confirm that: (i) you are able to print on paper or electronically save this ESRD for your future reference and access; or (i) you are able to email this ESRD to an email address where you will be able to print on paper or save it for your future reference and access.
Validity of Electronically Signed or Delivered Documents
You understand that by accepting this ESRD, you are: (i) agreeing that any electronically signed document is legally valid and enforceable, just as if you had signed it manually on paper; and (ii) agreeing to receive electronically any notices and disclosures required under applicable law. You may withdraw your consent at any time.
Scope of Consent
You agree to receive electronic notices, disclosures, and electronic signature documents with all related and identified documents and disclosures provided over the course of your relationship with Patterson-Insurance. This includes, but is not limited to, insurance quotes, policy documents, claims information, and privacy notices. For residents of Arkansas, starting July 1, 2026, under the Arkansas Children and Teens’ Online Privacy Protection Act, if you are under 18, additional consents may be required for processing personal data related to targeted advertising or profiling, and we will implement age verification where applicable. You may withdraw your consent at any time by following the procedures described below.
Paper Copies
You can download and print documents when you receive any document. For documents to be signed, you can download or print either before or after you electronically sign. You will also receive notice when all parties have electronically signed the document and will be able to read and print it. Additionally, at any time upon request, Patterson-Insurance will provide, at no charge, a paper copy of any record provided or made available electronically, including legally binding agreements you sign electronically. You can request a paper copy by contacting us as described below.
Withdrawing Consent
You can withhold your consent to electronic disclosures by selecting “Reject.” Even if you accept now (agreeing to receive notices and disclosures from Patterson-Insurance electronically), you can change your mind later and withdraw your consent to receive paper notices in the future. To withdraw consent, contact us as described below. Note that withdrawal may limit your ability to use certain electronic services.
Impact of Selecting Paper Delivery
We understand if you prefer paper, but the paper process will take longer to complete, and you will not be able to sign electronically. It may slow the speed at which we can complete certain steps in transactions with you and deliver services because we will need to send required notices or disclosures in paper format and wait for your acknowledgment of
receipt.
Electronic Delivery/Updating Information
Unless you reject this ESRD or later withdraw consent, Patterson-Insurance will provide electronically all required notices, disclosures, authorizations, acknowledgments, and other documents during our relationship with you. To update or confirm the email address we use, contact us as described below, including your previous and new email addresses. We implement reasonable security measures to protect electronic communications, in line with Texas and Arkansas data protection requirements.
